Status:The concession was awarded to M/s SICAL on June 03,2010. The Concessionaire has not commenced work due to ban on export and movement of iron ore imposed by Karnataka Govt. The Concessionaire has requested to excuse for performance under Fource Majeure clause. M/s SICAL was given one more opportunity to commence the work before Apr 08, 2014 and give milestone accordingly, failing which necessary action may be taken to terminate the contract as per the provisions of the Concession Agreement. As resolved by the Port Trust Board, a letter to M/s SICAL is issued on Oct 08, 2013 and reminder letter sent on Jn 09, 2013, reply is awaited. Program is not yet submitted by M/s SICAL. M/s SICAL has filed writ against Board of Trustees NMP under article 226 & 227 of Constitution of India. Hon'ble High Court has given interim order date Feb 20, 2014 in the said WPdisposal of writ petition. i. Stay any further action that may be taken in relation to termination of the Concession Agreement between the Board of Trustees of NMPT and M/s SICAL. ii. Stay of the enforcement of any of the terms of the invoking/encashing the Bank Guarantee issued on behalf of M/s SICAL in terms of the Concession Agreement and from receiving any money under Bank Guarantee. Port is in process of vacating the stay. Hearing of the case has been completed and judgement may be pronounced on the next date. |
